Speedometer Calibration

Speedometer Calibration in Virginia Traffic Cases

A speedometer calibration test determines whether your vehicle’s speedometer is reading accurately. In some reckless driving or speeding cases, calibration evidence can play an important role, especially if the speedometer was defective at the time of the offense.

Under Virginia Code § 46.2-942, courts must accept a sworn calibration report as evidence. The law allows properly authenticated test results to be admitted without requiring the technician to appear in court.

A useful calibration report will show that the vehicle’s speedometer displayed a lower speed than the car’s actual speed. When that happens, the evidence can help support your defense.

Speedometer Calibration Is Evidence In a VA Reckless Driving Speeding Case

Mechanics use a device called a dynamometer, or “dyno,” to measure the accuracy of a vehicle’s speedometer. The test compares your actual speed to the speed displayed on the dashboard, usually in 10-mph intervals. Both digital and analog speedometers can be checked this way.

The calibration report should include two columns: one for the vehicle’s actual speed and one for the displayed speed. For the results to be admissible in court, the report must be signed by the technician and verified by a notary. You’ll often see “witnessed and sworn” language, which confirms the report is authentic.

A sworn calibration report is admissible under Virginia law, but how much weight it carries depends on the judge. Some judges give calibration reports considerable weight, especially when the test is performed close in time to the traffic stop. Others may discount the evidence or insist on seeing the original report instead of a scanned copy.

Why Calibration Can Help in Reckless Driving and Speeding Cases

Calibration evidence is not a guaranteed defense, but it can provide important context. If your speedometer reads lower than your actual speed, the report may help reduce the seriousness of the charge or support arguments for leniency. If you are facing reckless driving or other traffic charges in Virginia, our team can help you determine whether a speedometer calibration will strengthen your defense.
