How to Pay Court Fees and Fines

How to Pay Virginia Court Fees and Fines

how to pay court fees

In Virginia, a criminal offense or traffic violation can lead to fines and court costs. A fine is imposed only if the Court enters a conviction. Some traffic violations may be prepaid before the trial date, but in most cases, court costs are added when a conviction occurs, and in certain situations, costs may still apply even if the case is dismissed.

If payment is not made within 90 days of your court date, and you have not arranged a “time to pay” or deferred payment plan, your account may be sent to collections. Payments under such agreements must be made by the date set by the Court.

Not every charge requires a court appearance. It’s important to understand the allegation and potential consequences of not paying a fine. At Stanton Law, we have extensive experience defending clients in Virginia traffic and criminal cases, including reckless driving, DUI/DWI, and speeding. We provide clear guidance, protect your rights, and work toward the best possible outcome for your case.

Online Payments

Pre-Court Payments (before your court date):

Some traffic tickets and minor offenses can be prepaid online through the Virginia General District Court system. Payments must be processed before 3:30 p.m. on the business day before your court date. If your case is eligible, a “Mark for Payment” option will appear in the system. Prepaying your ticket is treated as a guilty plea and a waiver of trial.

Post-Court Payments (after your court date):

If you do not pay within 90 days of your court date and have not arranged a payment plan, your account will be sent to collections. Interest begins to accrue 181 days after your court date. Payments under a “time to pay” or deferred agreement must be made by the date set by the court. The Virginia Courts charge a convenience fee for each credit or debit card transaction made online.

Payments by Mail

Payments may also be mailed directly to the General District Court listed on your summons. To ensure timely delivery, mail payments at least seven days before your court date. Payments are considered received only when they reach the court, not when they are mailed.

Courts accept personal checks, money orders, certified checks, and some credit cards. Always make payments payable to the specific General District Court listed on your summons (for example, “Chesterfield General District Court”).

Important: Reckless driving charges cannot be prepaid and require a court appearance.

Refunds

Refund requests must be directed to the specific General District Court where payment was made.

Yes. Virginia courts allow defendants to set up payment plans for fines and costs. A payment plan may be:

Deferred payment agreement – no installments are due until the end of the term, when the full amount is paid.

Installment payment agreement – the defendant makes monthly or periodic payments until the balance is paid in full.

Modified deferred payment agreement – a deferred plan where the defendant also agrees to make best efforts toward monthly or periodic payments.

Courts must provide written notice about these options and, where available, the possibility of earning credit through community service. Judges consider each defendant’s financial resources and obligations when deciding the length and terms of a payment plan, and the plan must be reasonable. Payments received within 10 days of the due date are considered timely. Payment plans may also be modified at any point if there is a good-faith showing of financial need.
