Reckless Driving Win for Fairfax, VA Driver Cited at 94 MPH

Stanton Law is a leading criminal and traffic defense law firm in Richmond, Virginia. Recently, we successfully represented a driver facing a serious reckless driving charge in Fairfax County.

Our client was charged with reckless driving for allegedly traveling 94 mph in a 55 mph zone, 39 miles per hour over the posted limit. Under Virginia Code § 46.2-862, driving faster than 85 mph, or 20 mph or more above the speed limit, is charged as reckless driving. Reckless driving is a Class 1 misdemeanor, and a conviction can carry up to 12 months in jail, a six-month license suspension, and a fine of up to $2,500.

The judge reduced the charge to failure to pay full time and attention, a minor offense that does not affect our client’s driving record. The case resulted in no loss of license, no jail time, and no fine.
